Kate Lee Carey has served as Special Counsel with Cooley LLP’s Education Regulatory Practice Group since 2015. Since 2001, Kate’s practice has focused exclusively on the legal and regulatory aspects of high education including how those structures impact both institutions and the companies that provide services to them. Prior to joining Cooley, Kate was the General Counsel and Vice President for Government Affairs at a system of healthcare colleges in California, as well as serving as VP of Compliance, and Director of Regulatory Affairs, at institutions in Arizona and Colorado, respectively.
Kate has become a national expert on higher education compliance, encompassing accreditation, Title IV and Title IX regulations, and state authorization (including a 12-year stint on the CA BPPE Advisory Committee.) Kate’s 14 years working in-house provided her a useful perspective on how these regulatory structures and requirements impact school operations. She advises clients on a broad range of topics from day-to-day compliance questions to leading the regulatory aspects of school transactions, responding to ED actions, and advising on regulatory aspects in litigation. She also closely tracks changes to federal regulations and how they impact institutions, such as gainful employment, borrower defense to repayment, financial responsibility, administrative capability, incentive compensation, third party servicer rules, and 90/10 compliance, authoring alerts and providing training on how to plan for the seemingly never-ending barrage of updates.
